1. Introduction

1.1 Objective. Danse Bloom Productions Inc. (“Danse Bloom”, “we”, “us”, “our”) respects your privacy and is committed to protecting it by complying with this Privacy Policy.1.2 Privacy Policy. This policy describes:

a) The type of information we may collect or that users of the App (“you”) may provide when purchasing, downloading, installing, creating an account, accessing, or using the Danse Bloom App (the “App”).

b) The types of information we may collect from you or that you may provide to us when you visit the https://www.dansebloom.com/ website (the “Website”).

c) our practices for collecting, using, maintaining, protecting, and disclosing that information.

1.3 Privacy Policy application. “Personal information” means any information which relates to a natural person and allows that person to be identified. This policy applies to information we collect, use, or disclose about users: (i) on the App; (ii) on the Website; (iii) in emails, texts and other electronic messages exchanged between users and Danse Bloom; and (iv) any other sources.

1.4 Consent. By accessing or using the Website and the App, the user indicates that they understand, accept, and consent to the practices described in this Privacy Policy. This policy may change from time to time. 

2. Method of Collecting Information. We use different methods to collect information, including through:

a) Direct interactions with a user when they provide it to us, for example, by filling in forms or corresponding with us by phone, email, or otherwise;

b) automated technologies or interactions, as you use our Website and App. Information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies;

c) information that is collected by using our services. 

3. Information collected. We collect and use several types of information from and about users, including:

a) Personal information that can be reasonably used to directly or indirectly identify users, such as their name, email address, age, video, photo, city (province\state and country), education and training, Internet protocol (IP) address used to connect your device to the Internet, and any other identifier that may be used to contact the user;

b) statistical or aggregate data that does not directly identify a specific person, but we may derive non-personal anonymized statistical or aggregated data from personal information; 

c) technical information, including login information, browser type and version, time zone setting, browser plug-in types and versions, operating systems and platforms, Internet connection information, equipment used to access our Website or App, and details of the use of our Website and App.

4. Information you provide to us

4.1 When you download, register an account or use this App and Website, we may ask you to provide:

a) Information that you provide by filling in forms on our Website and App. This includes information provided at the time of registering to use our App and posting material on the App and Website. We may also ask you for information when you enter a contest or promotion sponsored by us, and when you report a problem with our Website or the App.

b) Your responses to surveys that we might ask you to complete for research or improvement purposes regarding the Website or the App.

c) Details of transactions you carry out through our Website or App. You may be required to provide financial information before you subscribe to the App. 

d) Your search queries on the App and Website.

4.2 The Basic Account does not allow you to provide information for posting on public areas of the Website and the App. However, you may provide information for posting purposes with the following account types: Aspiring, Professional and Premium. These accounts allow you to post and make available information about yourself at your own risk. Please be aware that no security measures are perfect. We cannot control the actions of third parties. Therefore, we cannot guarantee that unauthorized persons will not see your postings on public areas of the Website and the App.

5. Automatic Collection and Tracking Technologies. When you download, access and use the App and Website, we may automatically collect: 

a) Usage details. When you access and use the App or Website, we may automatically collect certain details about your access to and use of the Website and App, including traffic data, location data, and other communication data and the resources that you access and use on or through the App and Website.  

b) Device information. We may collect information about your device and Internet connection, including the device’s unique device identifier, IP address, operating system, browser type, mobile network information, and the device’s telephone number. 

c) Stored information and files. The App and Website may also access metadata and other information associated with other files stored on your device. This may include, for example, photographs, audio and video clips, personal contacts, and address book information. 

d) Location information. The App and the Website do not collect real-time information about the location of your device.

5.1 The technologies we use for this automatic data collection may include: 

a) Cookies (or mobile cookies). A cookie is a small file placed on your device. You can refuse to accept cookies by activating the appropriate settings on your device. However, by enabling these settings, you may not be able to access certain parts of our App and Website. 

b) Web beacons. The App and the Website may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags and single-pixel gifs) that allow Danse Bloom, for example, to count users who have visited those pages and for other related Website or App statistics (for example, to record the popularity of certain content on the App and to verify system and server integrity). 

5.2 The information we collect automatically is statistical information and may include personal information, and we may maintain it or associate it with personal information we collect in other ways, that you provide to us, or receive from third parties. This usage information helps us to improve our App and Website and provide a more personalized service, including by enabling us to: 

a) Estimate our audience size and usage patterns.

b) Store information about your preferences and customize our App and Website according to your individual interests.

c) Speed up your searches. 

d) Recognize you when you return to the App. 

5.3 If you do not want us to collect this information, do not download the App and do not access our Website or delete the App from your device.

6. Information collected by third parties

6.1 When you use our services, certain third parties may collect data about you. This may be information that you submit (such as financial information) or information that is automatically collected (in the case of third-party analytics providers or advertising partners).

6.2 We may also obtain information about you from third parties. This information may be combined with information we have already collected. For example, some advertisers or advertising platforms may allow us to determine which other online services you use, in order to place targeted advertisements on those services.

7. Use of Information. We use the information we collect:

a) To provide you with the App and Website, and their content.

b) To provide you with the information, products or services you request from us.

c) To fulfill the purposes for which you provided the information or as described at the time of collection or that were described when it was collected, or any other purpose for which you provide it.

d) To provide you with notices regarding your account/subscription, including expiration and renewal notices. 

e) To carry out our obligations and enforce our rights arising from any contracts with you or to comply with legal requirements. 

f) To inform you of the availability of updates to the App and changes to any products or services we offer or provide through it. 

g) To notify you about changes to our Website/App or any products or services we offer or provide through it.

h) To improve our App, Website, products or services, or our relationships and experiences with users. 

i) For marketing purposes.

j) To allow you to participate in interactive features, or other features of our App or Website. 

k) To measure or understand the effectiveness of the advertising we serve to you and to others, and to deliver relevant advertising to you. 

l) To prepare anonymized reports that may or may not be sold to third parties or posted on our Website. 

m) For any other purpose with your consent. 

8. Disclosure of information

8.1 Aggregate Information. We may disclose aggregated information about our users, and information that does not identify any individual, without restriction. 

8.2 Personal Information. We may disclose personal information that we collect or that you provide, as described in this Privacy Policy:

a) To our subsidiaries and affiliates, third parties, partners, service providers involved in fulfilling the purposes for which your personal information was collected.

b) According to applicable law, to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Danse Bloom’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Danse Bloom’s about our users is among the assets transferred.

c) To fulfil the purpose for which you provide it.

d) For any other purpose disclosed by us when you provide the information.

e) With your consent.

f) To comply with any court order, statute or legal process, including responding to a request from a government or regulatory agency, in accordance with applicable law.

g) To enforce or apply our terms of use.

h) If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Danse Bloom, our users, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

9. Transferring your personal information 

9.1 We may transfer personal information that we collect or that you provide as described in this Privacy Policy to contractors, service providers and other third parties that we use to support and optimize the App/Website and who are contractually obligated to keep personal information confidential, use it only for the purposes for which we disclose it to them, and to process the personal information with the same standards as set out in this Privacy Policy. 

9.2 We may process, store and transfer your personal information in and to foreign country, with different privacy laws that must be comparable to Canadian laws. In these circumstances, the governments, courts, law enforcement agencies or regulatory agencies of that country may be able to obtain access to your personal information, through the laws of the foreign country. Whenever we engage a service provider, we require that its privacy and security standards adhere to this Privacy Policy and applicable Canadian privacy legislation.

10. Data security. 

10.1 Security of Personal Information. We use commercially reasonable physical, electronic and administrative measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure.

10.2 User Responsibility. Once users have chosen to create an account and password, they are responsible for maintaining the confidentiality of their password. 

10.3 Transmission of information. We do not guarantee the security of personal information transmitted by a user. Any transmission of personal information is at the user’s own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website and the App.

11. Data Retention. Except as otherwise permitted or required by applicable law or regulation, we will only retain your personal information for as long as necessary to fulfill the purposes for which it was collected, including to satisfy any legal, accounting or reporting requirements. In certain circumstances, we may anonymize your personal information so that it can no longer be associated with you. We reserve the right to use such anonymized and de-identified data for any legitimate business purposes without further notice to you or your consent. 

12. Children under the age of 14. Our App and Website are not intended for children under the age of 14. No one under the age of 14 may provide us with personal information. We do not knowingly collect personal information from children under the age of 14. If you are under 14, do not use or provide any information through our services. If we learn that we have collected or received personal information from a child under 14, we will delete that information. If you believe that we may have information from or about a child under the age of 14, please contact our Privacy Officer. 

13. Access and correction of personal information

13.1 Changes to Personal Information. It is the user’s responsibility to inform us of any changes to their personal information. 

13.2 Requesting Access to Personal Information. We may request specific information from a user to help confirm their identity and right to access it, and to provide a user with the personal information held by us or to make the requested changes. Applicable law may allow or require us to refuse to provide you with access to some or all of the personal information that we hold about you, or we may have destroyed, erased, or made your personal information anonymous in accordance with our record retention obligations and practices. If we cannot provide you with access to your personal information, we will inform you of the reasons why, subject to any legal or regulatory restrictions.

13.3 Privacy Officer. If you want to review, verify, correct or withdraw consent to the use of your personal information, the user may send us an email at the email address of the Privacy Officer to request access to, correct, or delete any personal information that you have provided to us.

14. Withdrawal of Consent. Where a user has provided their consent to the collection, use, and transfer of their personal information, the user may have the legal right to withdraw your consent under certain circumstances. To withdraw consent, if applicable, contact the Privacy Officer. Please note that if the user withdraws consent, we may not be able to provide the user with a certain product or service.

15. Changes to the Privacy Policy. Privacy laws are rapidly evolving and, as a result, this Privacy Policy may be changed from time to time, in Danse Bloom’s full discretion, without any prior notice or liability to you or any other person. The collection, use and disclosure of your personal information by Danse Bloom will be governed by the version of this Privacy Policy in effect at that time. We will notify you of any material changes to this Privacy Policy by email, and your continued use of the Website and the App will be considered as consent to the amended Privacy Policy. The date the Privacy Policy was last revised is included at the top of the page. It is your responsibility to ensure that we have an up-to-date email address and to check this Privacy Policy regularly for changes.

16. Challenging compliance with this Privacy Policy. Danse Bloom will respond to complaints from individuals or questions about our compliance with this Privacy Policy and with applicable privacy laws.
